RE: YOUR LETTER DATED FEBRUARY 5, 2002

Dear Sheriff Manning,

You do not seem to have read the letter we sent. Please serve the criminal court capias first. Serve them as soon as possible after they are issued.

Serving stale warrants, particularly old misdemeanor warrants, is not what we are requesting as a priority. We have no idea who your "Ten Most Wanted" is. But if they have not been indicted by a grand jury and you are relying solely on warrants taken by officers which no D.A. or Judge has evaluated, you may want to proceed with some caution. Generally our office proceeds to indictment when serious offenses have been committed and there is adequate proof as to who committed the offense.

If your "Ten Most wanted" are not under indictment you need to consult with us and possibly the County Attorney before putting posters in public places. We know Linda is not out serving papers. She has a full time job keeping the records.

Please instruct Jeff Smith (who you state is serving process) to serve any outstanding capias and to get the capias issued each month from grand jury and serve these as priority.

Do not serve misdemeanor warrants a year old (unless there is a new arrest of same defendant) without checking that the old case is still viable.
